# Finder - Terms of Service

These terms ("Agreement") govern your use of Finder ("the Software"), a local file-launcher utility developed and distributed by Ansh Dadhich (the "Developer", "we", "us").

## 1. Acceptance

By downloading, installing, or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

## 2. License

The Software is free to use. You may install and use it on any number of computers you own or manage, and you may share or distribute the installer **unmodified** (including this documentation and the privacy policy). You may not sell the Software, reverse-engineer it beyond what the law permits given its open-source availability, or use it to build a competing product without written permission.

## 3. The Software is provided "AS IS"

**Finder is provided without warranty of any kind, express or implied - including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.** The Developer does not guarantee that the Software will be error-free, that it will run on every system, or that it will remain available in its current form.

## 4. Limitation of liability

**To the maximum extent permitted by law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of data, loss of profits, loss of privacy, corruption of files or the NTFS index, system slowdowns, hardware damage, business interruption, or any claim arising out of or in connection with the use or inability to use the Software.** This limitation applies even if the Developer has been advised of the possibility of such damages.

Finder only reads file **names** for indexing and does not modify, move, or delete your files. However, you acknowledge that:

- **File actions** (opening, launching, "Open location", etc.) are performed at your command and your responsibility.
- **The "copy/move/delete" or batch operations**, if and where present, are irreversible actions performed on your files at your request; you are responsible for backing up data before using them.
- **Security.** No software is immune to vulnerabilities or attacks. You accept the residual risk of using third-party software on your system, including the possibility of exploits in Finder, its bundled components (WebView2 runtime, Windows APIs), or the update delivery channel. The Developer works to fix reported issues but makes no guarantee of immunity.

## 5. Privacy

Your use of Finder is subject to the [Privacy Policy](./PRIVACY_POLICY.md), which is incorporated into this Agreement by reference.

## 6. Updates

The Software may check for and install updates automatically (from GitHub Releases). This helps us fix bugs and security issues. You can disable updates or uninstall at any time. By using an old version you accept the risks of running unpatched software.

## 7. Intellectual property

The Finder name, logo, and branding belong to the Developer. The source code is published openly for review; the Developer retains ownership and grants you no rights beyond the license in section 2.

## 8. Termination

You may stop using and uninstall the Software at any time. We may stop distributing or updating the Software at any time, without liability to you. Sections 3, 4, 5, and 7 survive termination.

## 9. Governing law

To the extent permitted, this Agreement is governed by the laws of India, without regard to conflict-of-law rules. Any disputes shall be resolved in the courts of India.

## 10. Changes

We may revise these terms. Material changes will be posted in the repository alongside the corresponding release notes, and continued use after changes constitutes acceptance.
